Welcome to GiftCrew! These Terms of Service ("Terms") govern your use of the GiftCrew mobile application and website (collectively, the "Service") operated by GiftCrew ("we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Description of Service
GiftCrew is a birthday wishlist and gift coordination platform that allows you to:
- Create and manage birthday wishlists
- Join groups with friends and family
- View other group members' wishlists
- Claim items to coordinate gift-giving and avoid duplicates
- Organize Secret Santa groups with random name draws and anonymous chat
- Communicate with group members through chat (Pro feature)
- Receive birthday reminders and notifications
2. Accounts
Account Creation
To use the Service, you must:
- Be at least 13 years of age
- Provide accurate and complete information
- Maintain one account per person
- Keep your account credentials secure
Account Responsibilities
You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, please contact us immediately at support@giftcrew.app.
3. Subscriptions and Payments
Free Plan
The free plan includes:
- Up to 10 wishlist items
- Up to 3 groups
- Basic features
Pro Plan
The Pro plan ($4.99/month or $41.88/year) includes:
- Up to 50 wishlist items
- Up to 20 groups
- Group chat functionality
- AI-powered gift suggestion credits (see AI Suggestion Credits section below)
- All premium features
Payment Processing
Payments are processed through:
- Web: Stripe (via Clerk)
- Android: Google Play Store
- iOS: Apple App Store
Billing
Subscriptions automatically renew unless cancelled before the renewal date. You can manage your subscription through:
- The app's subscription settings (web)
- Google Play Store settings (Android)
- App Store settings (iOS)
Refunds
Refund requests are handled according to the policies of the respective payment platform:

4. AI Suggestion Credits
Credit Allocation
Pro plan subscribers receive a fixed number of AI suggestion credits each calendar month. The current allocation is displayed in-app and may be adjusted with notice.
Accumulation
Unused credits carry over to subsequent months and remain available for use as long as the credit has not expired.
Expiration
Each credit grant expires twelve (12) months from the date it was issued. Expired credits are automatically removed and cannot be recovered. We will notify you in-app when credits are approaching expiration (7 days, 3 days, and 1 day prior).
Consumption Order
When you use AI suggestion credits, the oldest available credits are consumed first (first-in, first-out).
Non-Transferable
Credits are personal to your account and cannot be transferred, sold, or exchanged.
No Cash Value
Credits have no monetary or cash value and cannot be redeemed for cash.
Cancellation / Downgrade
If you cancel or downgrade your subscription, your existing unused credits remain available until their individual expiration dates. No new credits will be issued while on the Free plan.
AI-Generated Content Disclaimer
AI suggestions are generated by third-party AI services and are provided for informational purposes only. We do not guarantee the accuracy, availability, or suitability of any suggested products or services.
5. User Content
Your Content
You retain ownership of the content you create, including wishlist items, messages, and uploaded images ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the Service.
Content Visibility
User Content you post may be visible to other users according to your privacy settings and group memberships. Wishlist items are visible to members of your groups. Gift claims are hidden from the birthday person but visible to other group members.
Content Removal
You can delete your own wishlist items and messages at any time. We reserve the right to remove content that violates these Terms.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or harm other users
- Post spam, misleading content, or advertisements
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service
- Impersonate another person or entity
- Post content that infringes on intellectual property rights
- Post content that is hateful, violent, or sexually explicit
- Create multiple accounts to circumvent limitations or bans
- Use automated systems to access the Service without permission
7. Intellectual Property
The Service, including its design, features, and content (excluding User Content), is owned by GiftCrew and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
The GiftCrew name, logo, and related trademarks are our property and may not be used without permission.
8. Termination
By You
You may stop using the Service at any time. You can delete your account directly through your profile settings.
By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to notify you before termination when possible.
Effect of Termination
Upon termination, your right to use the Service ends immediately. Your personal data (profile, wishlist items, images, billing records, notification subscriptions, and AI suggestion data) will be deleted. Messages you previously sent in group chats are retained in a de-identified form (displayed as "Deleted user") to preserve conversation context for other group members. Chat threads about your wishlist are deleted along with your wishlist items. Groups where you are the only member are deleted. Groups with other members remain active, and ownership is automatically transferred to another group member. We are not obligated to provide copies of your data after deletion.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy, reliability, or quality of User Content posted by other users.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTCREW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you through the app or by email.
Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
