Terms of service

Welcome to GiftCrew! These Terms of Service ("Terms") govern your use of the GiftCrew mobile application, website, and browser extension (collectively, the "Service") operated by Răileanu Emanuel-Alin PFA, a sole trader (persoană fizică autorizată) registered in Romania, whose details are under Contact us ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of service

GiftCrew is a birthday wishlist and gift coordination platform that allows you to:

• Create and manage birthday wishlists
• Add products to your wishlist from a product link, or from a shop's page with the GiftCrew browser extension
• Join groups with friends and family
• View other group members' wishlists
• Claim items to coordinate gift-giving and avoid duplicates
• Organize Secret Santa groups with random name draws
• Create event groups with a shared wishlist built by the people being celebrated
• Communicate with group members through gift chat, event chat, and Secret Santa chat in groups whose owner has a Pro subscription
• Receive birthday, event, and Secret Santa reminders and notifications

2. Accounts

Account creation

To use the Service, you must:

• Be at least 13 years of age
• Provide accurate and complete information
• Maintain one account per person
• Keep your account credentials secure

Account responsibilities

You are responsible for all activity that occurs under your account. If you suspect unauthorized access to your account, please contact us immediately at support@giftcrew.app.

3. Subscriptions and payments

Free plan

The free plan includes:

• 1 wishlist with up to 5 items
• Up to 3 groups, counting every group you create or join
• Secret Santa groups, event groups, birthday tracking, and reminders

Every group can have up to 50 members on any plan. Chat in a group is available to its members when the group's owner has a Pro subscription. AI gift suggestions are available on the Pro plan.

Pro plan

On the web, Pro costs $4.99 per month, or $41.88 per year with yearly billing. These prices are final: no VAT is added, because Răileanu Emanuel-Alin PFA is not registered for VAT. In the Android app, Google Play shows the price in your local currency. Pro includes:

• Up to 10 wishlists, with up to 50 items on each
• Up to 20 groups
• Gift chat, event chat, and Secret Santa chat for all members of groups you own
• AI-powered gift suggestion credits (see AI Suggestion Credits section below)

Free trial

We may offer a 14-day free trial of Pro. Starting a trial requires a valid payment method. Unless you cancel before the trial ends, it automatically converts to a paid Pro subscription on the billing period you chose when you started it: $4.99 per month, or $41.88 per year for yearly billing. You are charged through the payment method you provided when the trial ends.

Payment processing

Payments are processed through:

• Web: Stripe (via Clerk)
• Android: Google Play Store

Billing

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time; Pro stays active until the end of the period you have already paid for. You can manage your subscription through:

• Settings → Subscription → Manage subscription (web)
• Google Play Store settings (Android)

Right of withdrawal and refunds

You can withdraw from a Pro subscription within 14 days of the day you subscribe, without giving a reason, and we refund anything you paid in that time.

• With the free trial (your first subscription), those 14 days are the trial. Cancel before it ends, in Manage subscription or in Google Play, and you are never charged. Nothing else is needed.
• Without a trial (when you subscribe again later), you pay when you subscribe. Withdraw within 14 days of that payment and we refund it in full.

Payments after the 14 days, including the first payment after a free trial and later renewals, aren't refunded, but you can cancel before any renewal.

To withdraw after paying, email support@giftcrew.app from the address on your GiftCrew account and say that you withdraw from your subscription. You can use the form below, but you don't have to. We refund you within 14 days of your message, to the payment method you paid with, and Pro ends when the refund is made. This works for subscriptions bought on the web and through Google Play; for Google Play you can also ask Google directly under the Google Play refund policy.

4. AI suggestion credits

Credit allocation

Pro plan subscribers receive three (3) AI suggestion credits for each calendar month (UTC) in which they use AI suggestions. A month's credits are added the first time you use AI suggestions in that month; months in which you do not use them add no credits. The current allocation is displayed in-app and may be adjusted with notice.

Accumulation

Unused credits remain available in later months until they expire.

Expiration

Each credit grant expires twelve (12) months from the date it was issued. Expired credits are automatically removed and cannot be recovered. We will notify you in-app when credits are approaching expiration (7 days, 3 days, and 1 day prior).

Consumption order

When you use AI suggestion credits, the oldest available credits are consumed first (first-in, first-out).

Non-transferable

Credits are personal to your account and cannot be transferred, sold, or exchanged.

No cash value

Credits have no monetary or cash value and cannot be redeemed for cash.

Cancellation / downgrade

If you cancel or downgrade your subscription, your existing unused credits remain available until their individual expiration dates. No new credits will be issued while on the Free plan.

AI-generated content disclaimer

AI suggestions are generated by third-party AI services and are provided for informational purposes only. We do not guarantee the accuracy, availability, or suitability of any suggested products or services.

5. User content

Your content

You retain ownership of the content you create, including wishlist items, messages, and uploaded images ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

Content visibility

User Content you post may be visible to other users according to your group memberships. Items on each of your wishlists are visible to members of the groups that see that list. Gift claims are hidden from the person whose wishlist it is (and from the people being celebrated in an event group) but visible to other group members.

Content removal

You can delete your own wishlist items and messages at any time. We reserve the right to remove content that violates these Terms.

6. Acceptable use

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Post spam, misleading content, or advertisements
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service
• Impersonate another person or entity
• Post content that infringes on intellectual property rights
• Post content that is hateful, violent, or sexually explicit
• Create multiple accounts to circumvent limitations or bans
• Use automated systems to access the Service without permission

7. Intellectual property

The Service, including its design, features, and content (excluding User Content), is owned by GiftCrew and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

The GiftCrew name, logo, and related trademarks are our property and may not be used without permission.

8. Termination

By you

You may stop using the Service at any time. You can delete your account directly from the account menu in the app (select your profile picture, then Manage account).

By us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to notify you before termination when possible.

Effect of termination

Upon termination, your right to use the Service ends immediately. Your personal data (profile, wishlist items, images, billing records, notification subscriptions, and AI suggestion data) will be deleted. Messages you previously sent in group chats are retained in a de-identified form (displayed as "Deleted user") to preserve conversation context for other group members. Chat threads about your wishlist are deleted along with your wishlist items. Groups where you are the only member are deleted. Groups with other members remain active, and ownership is automatically transferred to another group member. We are not obligated to provide copies of your data after deletion.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy, reliability, or quality of User Content posted by other users.

Product details that GiftCrew fills in from a link, or that the browser extension reads from a shop's page, such as names, descriptions, and photos, come from third-party shops and remain the property of their owners. Apart from the affiliate programs described under Affiliate links, we are not affiliated with those shops, and we do not guarantee that these details are accurate or current. Links on wishlists lead to websites we do not control, and any purchase you make there is between you and that shop.

10. Affiliate links

Some links to shops in the guides on our website are affiliate links, for example through the Amazon Associates Program or Etsy's affiliate program. If you buy something after clicking one, the shop may pay GiftCrew a commission. The price you pay is the same, and you never pay us anything for using these links.

Affiliate links appear only in the guides on our website. We never add them to anyone's wishlist, and the app and the browser extension contain none. We choose the gift ideas in our guides ourselves; shops do not pay to be included.

A purchase you make through one of these links is between you and the shop, under its terms. The shops tell us which items earned a commission, but not who bought them.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIFTCREW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Changes to terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you through the app or by email.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
